Bullying Synonyms
Its clear that bullying is on the increase, we see it on the social networks especially from people who hide their identity - lets talk about this problem and over the next few weeks look at real life examples.

Types of bullying:

  • Physical
  • Verbal
  • Relational
  • Collective
  • Mobbing 

Over the next few weeks lets focus on - online bullying and its long term affects. What is the motivation of a bully and how as a collective of friends and acquaintances we can help lessen the impact. 

Cyber-bullying

Cyber bullying is the use of technology to harass, threaten, embarrass, or target another person. When an adult is involved, it may meet the definition of cyber-harassment or cyberstalking - a crime that can have legal consequences and involve jail time. This includes email, instant messaging, social networking sites (such as Facebook), text messages, and cell phones.

Trolling

The Internet has opened up the world to everyone. Unfortunately, some people use these platforms as means of inciting unwanted, often circular, arguments, launching repeated attacks and monitoring people’s activity without their consent.  Those who behave abusively online are referred to as internet trolls, and examples of ‘trolling’ include: -
  • Posting repeated ‘comments’ on message boards or news articles, attacking someone’s
    character and/or invading their privacy, or designed to provoke argument
  • Repeatedly sending abusive or otherwise upsetting Tweets or making false statements. 
  • ‘Following’ a person into online chat-rooms or Facebook in order to interrupt conversations and invade their privacy
  • Encouraging others to make rude and abusive comments. 
  • Sharing negative posts on as many different mediums as possible. 
Trolls or cyber bully's sometimes labour under the misapprehension that they can say and do what they want online.  Alternatively, they may take the view that they can get away with 
it (perhaps by disguising their identity).
Everyone has a right to enjoy what this world has to offer without fear of attack – and that extends to the World Wide Web.  Under the law of England and Wales, any course of conduct (two or more incidents) designed to cause a person alarm or distress, or where the perpetrator ought to know that is the likely outcome, is harassment.  It is a defense for the perpetrator to show that their conduct was reasonable, but with ‘trolling’ this will rarely be the case.
Harassment is a criminal offence contrary to the Protection from Harassment Act 1997 and punishable by up to six months’ imprisonment.  Victims should consider whether they wish to make a report to the Police.   Unfortunately, however, the Police are often overstretched and under-resourced,  online crime of this nature is sometimes not seen as a priority.

I thought it best to post this here - as a few people have been asking  and I can signpost them to this blog and add more information as required: 


Collective actions – where multiple claimants with claims sharing common characteristics seek a remedy against the same defendant or multiple defendants  


CFA

A CFA's is defined as  ' an agreement with a person providing litigation or advocacy services with provides for his fees and expenses, or any part of  them, to be payable only in specified circumstances' 

DBA

DBA's are a form of no win no fee arrangement. If the claimant wins then the legal representative is a percentage of the damages recovered. if the claimant is unsuccessful, then no payment of fees is sought. A DBA must be in writing (a contract) and generally must not require payment by the client for anything other than the contingency fee and or any expenses, net amounts recoverable from another party. This contingency fee must not exceed 50% of the sums ultimately recovered by the client at first instance.

(Claire this is what has been offered).


Public funding in the form of civil legal aid is limited to a narrow category of cases in the UK and is subject to strict qualification requirements. Therefore, it is unlikely to be available for many collective actions.

Crowd funding is used more and more  and worth considering.


The Court has the discretion to award a party its costs, typically on the "loser pays" principle.  


Contract

A voluntary, deliberate, and legally binding agreement between two or more competent parties - Existence of a contractual relationship does not necessarily mean the contract is enforceable, or that it is not void.

'Voluntary and two people are key here Claire you can not force or imply a contract has been agreed by just stating it. ' Confidentiality agreements work the same way'.

What is Fair dealing?
Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.
‘Fair dealing’ is a legal term used to establish whether a use of copyright material is lawful or whether it infringes copyright. There is no statutory definition of fair dealing - it will always be a matter of fact, degree and impression in each case. The question to be asked is: how would a fair-minded and honest person have dealt with the work?
Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
  • does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
  • is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used

The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

We so often see this thrown at individuals ' copyright breach!' if you copy an image or an image is included in a picture then you need to apply the above. You may or may not need to provide sufficient acknowledgement. Critique is allowed.

How Corrupt is the Irish Government? we come back to Greyhound Racing

Yet again we see how corrupt Greyhound racing is - this continued support by the government can only signify that have some sort of vested interest in the gambling and drug-ridden world of greyhound racing where the poor dogs are mistreated sold to china/japan, mistreated, abused, dumped and pts when they no longer have offer any value to the 'owner' greedy bastard!

It was also been reported that dosing this lovely breed with cocaine - a practice that is supposed to be banned - is still prevalent 

Champion Tristar

Tristar a Four -old flyer Tristar was caught with the Class A party drug in his system after blowing away rivals on the track.
The substance, which can boost performance, was discovered in a urine sample taken before he stormed to victory at the Shawfield track in Rutherglen, near Glasgow.
But despite fining trainer William Rae, 70, a disciplinary hearing ruled the bizarre case a “mystery” and let him keep his license.
In a statement, the Greyhound Board of Great Britain said: “Something has gone seriously wrong when it is found that a greyhound has been exposed to cocaine.”
Talented champ Tristar, who has racked up five wins at Shawfield during his 35-race career, won last October’s meeting in less than 30 seconds.

When will the UK and the Irish government wake up to this corruption as right now they appear to be embedded within it!

Someone asked me the other day. Who are you?  I was very tempted to say 'I can be whoever you want me to be' but it really was not the right moment!! and those days are far and few between now!

Has the UK gone mad? Painting horses! Nooooooooo


This is just bizarre!! weird, crazy stupid -  I spotted this petition on Change.org 

Painting Horses?  - the company doing this has now stopped 

WTF !!! What is the matter with people??  I Googled to see who was offering this bizarre and downright cruel service .. Horses are not canvas or paper they are real-life living things .. who in their right mind could possibly think they would enjoy being tied up with a bunch of kids and painted! what does this teach the kids! Certainly not respect --  just a gimmick.. I agree with PETA

Just a suggestion.. might sound a bit 'out there' how about.. Paper - Canvas - A blackboard' if the kids enjoy the therapy of touching a horse ( and the horse is happy) then stick to that! Horse painting is ludicrous..

Petitions that Matter .. Susie Sleuth Sleaker

I love animals.. can't help it..  so the focus right now is those that need our help ..


It just a petition .. it won't make a difference well it does!

Especially the parliament ones.. so come on get signing - do your bit protest and take action .. your sitting there reading this - get off the damn sofa and do something more constructive!

Sooooo here is the first one - and I will add info ( to save you lazy sods) so you understand exactly why it needs signing.

Ban the sale of puppies by pet shops & all commercial 3rd party dealers.

Why wouldn't you want to ban them.

If you are a breeder (someone who breeds for health and love the animal) you will want it banned - if you are  Greeder ( a person who breeds for money only )  then you won't.

So stop the Greeders you say?  yes, that's a good idea but how? this petition helps

Who are the biggest problem to pets ? you .. anyone of you who has decided they want a pet and just walked into a shop and bought one? Yes, YOU!  its wrong its bad for the animals if you are getting a pet whether it be a mouse or an elephant plan, organise and do your research! Just like you do when you buy a car. Yes, its a life.. it matters.. and if you don't agree then you should NOT be allowed to have one. There I have said it.

If we take more responsibility for our actions a lot of these bad get rich quick scumbags would not be able to do what they do.

Educate yourselves.. educate all those around you.. 

Do not assume people know the right way to do it.. talk to them  ..

Sorry to say I lost my previous blog 'he he' well that has never stopped me!
