Its clear that bullying is on the increase, we see it on the social networks especially from people who hide their identity - lets talk about this problem and over the next few weeks look at real life examples.

Types of bullying:

  • Physical
  • Verbal
  • Relational
  • Collective
  • Mobbing 

Over the next few weeks lets focus on - online bullying and its long term affects. What is the motivation of a bully and how as a collective of friends and acquaintances we can help lessen the impact. 

Cyber-bullying

Cyber bullying is the use of technology to harass, threaten, embarrass, or target another person. When an adult is involved, it may meet the definition of cyber-harassment or cyberstalking - a crime that can have legal consequences and involve jail time. This includes email, instant messaging, social networking sites (such as Facebook), text messages, and cell phones.

Trolling

The Internet has opened up the world to everyone. Unfortunately, some people use these platforms as means of inciting unwanted, often circular, arguments, launching repeated attacks and monitoring people’s activity without their consent.  Those who behave abusively online are referred to as internet trolls, and examples of ‘trolling’ include: -
  • Posting repeated ‘comments’ on message boards or news articles, attacking someone’s
    character and/or invading their privacy, or designed to provoke argument
  • Repeatedly sending abusive or otherwise upsetting Tweets or making false statements. 
  • ‘Following’ a person into online chat-rooms or Facebook in order to interrupt conversations and invade their privacy
  • Encouraging others to make rude and abusive comments. 
  • Sharing negative posts on as many different mediums as possible. 
Trolls or cyber bully's sometimes labour under the misapprehension that they can say and do what they want online.  Alternatively, they may take the view that they can get away with 
it (perhaps by disguising their identity).
Everyone has a right to enjoy what this world has to offer without fear of attack – and that extends to the World Wide Web.  Under the law of England and Wales, any course of conduct (two or more incidents) designed to cause a person alarm or distress, or where the perpetrator ought to know that is the likely outcome, is harassment.  It is a defense for the perpetrator to show that their conduct was reasonable, but with ‘trolling’ this will rarely be the case.
Harassment is a criminal offence contrary to the Protection from Harassment Act 1997 and punishable by up to six months’ imprisonment.  Victims should consider whether they wish to make a report to the Police.   Unfortunately, however, the Police are often overstretched and under-resourced,  online crime of this nature is sometimes not seen as a priority.

Looks like the Greyhound Board of Great Britain have had to find yet another venue to congratulate themselves for exploiting greyhounds throughout the year & we will be right there to hold them to account. Once again the venue is at the Park Plaza. CAGED Nationwide, are hoping you join us once again for the annual GBGB awards protest.

Fireworks show right next door to Race track - Ban Greyhound Racing

Coral  - the barbaric owners who allowed greyhounds to be held in kennels right next door to Firework displays on Saturday - Hove racetrack did exactly the same!

Yet again there is evidence of the greed and cruelty of this 'bloodsport' because to me - that is what it is.. when will it end?

These are the fireworks going off now next to Belle Vue as the greyhounds are waiting in the holding kennels. You can hear the dogs crying out in fear. Shame on the track management for not cancelling tonight’s racing.     Video 

'At tonight's demo at Hove dog track the fireworks were deafening and Coral rubbed their hands with glee at the thought of more money from animal suffering. They tried to pretend they care by issuing a statement saying the racing would stop for half an hour but of course the fireworks were relentless for much longer. In the meantime the dogs were in the track kennels, no doubt out of their minds with fear. We had lots of passing support and an added inspiration when The League hired a trailer video to drive up and down outside the track calling for a ban on greyhound racing. We used megaphones because of course suddenly the objection was dropped and the children we were meant to be disturbing were at the fireworks display. Funny how Coral, the police and pro racers twist everything to suit themselves. Tonight we are angry for all the animals in distress and terror thanks to human selfishness. Ban fireworks, ban greyhound racing, Close Hove Dog Track'

There are 21 active (GBGB) registered stadiums in the UK: 20 are in England and one in Scotland. There are none  in Wales (just one independent one)

I thought it best to post this here - as a few people have been asking  and I can signpost them to this blog and add more information as required: 


Collective actions – where multiple claimants with claims sharing common characteristics seek a remedy against the same defendant or multiple defendants  


CFA

A CFA's is defined as  ' an agreement with a person providing litigation or advocacy services with provides for his fees and expenses, or any part of  them, to be payable only in specified circumstances' 

DBA

DBA's are a form of no win no fee arrangement. If the claimant wins then the legal representative is a percentage of the damages recovered. if the claimant is unsuccessful, then no payment of fees is sought. A DBA must be in writing (a contract) and generally must not require payment by the client for anything other than the contingency fee and or any expenses, net amounts recoverable from another party. This contingency fee must not exceed 50% of the sums ultimately recovered by the client at first instance.

(Claire this is what has been offered).


Public funding in the form of civil legal aid is limited to a narrow category of cases in the UK and is subject to strict qualification requirements. Therefore, it is unlikely to be available for many collective actions.

Crowd funding is used more and more  and worth considering.


The Court has the discretion to award a party its costs, typically on the "loser pays" principle.  


Contract

A voluntary, deliberate, and legally binding agreement between two or more competent parties - Existence of a contractual relationship does not necessarily mean the contract is enforceable, or that it is not void.

'Voluntary and two people are key here Claire you can not force or imply a contract has been agreed by just stating it. ' Confidentiality agreements work the same way'.

What is Fair dealing?
Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.
‘Fair dealing’ is a legal term used to establish whether a use of copyright material is lawful or whether it infringes copyright. There is no statutory definition of fair dealing - it will always be a matter of fact, degree and impression in each case. The question to be asked is: how would a fair-minded and honest person have dealt with the work?
Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
  • does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
  • is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used

The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

We so often see this thrown at individuals ' copyright breach!' if you copy an image or an image is included in a picture then you need to apply the above. You may or may not need to provide sufficient acknowledgement. Critique is allowed.

Greyhound Racing 1000's die every year - Change this !

Witnesses reported seeing the man pick up the dog and throw it into the freezing water in Hartlepool, County Durham, on 2 November.



Ministers are considering tightening regulations on greyhound welfare as campaigners claim tens of thousands die needlessly and “disappear” each year.
The industry should be more open about numbers of deaths and injuries, officials at the Department for Food, Environment and Rural Affairs (Defra) said as MPs prepare to examine welfare guidelines this week.
Campaign group Greyt Exploitations says it has found that at least 40,000 greyhounds have been injured in the past 10 years on British tracks, and 18,000 have died.

'Let's hope ministers are going to do more than 'consider' this has been going on for decades if they do nothing or an inadequate token gesture then it will continue to show the government is corrupt. We are a nation of animal lovers and our politics should reflect the view of the people'

Yet again we see how corrupt Greyhound racing is - this continued support by the government can only signify that have some sort of vested interest in the gambling and drug-ridden world of greyhound racing where the poor dogs are mistreated sold to china/japan, mistreated, abused, dumped and pts when they no longer have offer any value to the 'owner' greedy bastard!

It was also been reported that dosing this lovely breed with cocaine - a practice that is supposed to be banned - is still prevalent

Tristar a Four -old flyer Tristar was caught with the Class A party drug in his system after blowing away rivals on the track.
The substance, which can boost performance, was discovered in a urine sample taken before he stormed to victory at the Shawfield track in Rutherglen, near Glasgow.
But despite fining trainer William Rae, 70, a disciplinary hearing ruled the bizarre case a “mystery” and let him keep his license.
In a statement, the Greyhound Board of Great Britain said: “Something has gone seriously wrong when it is found that a greyhound has been exposed to cocaine.”
Talented champ Tristar, who has racked up five wins at Shawfield during his 35-race career, won last October’s meeting in less than 30 seconds.

When will the UK and the Irish government wake up to this corruption as right now they appear to be embedded within it!

Preventing Suicide -The Silent Killer




Help Matthew make a Difference 



Matthew’s brother Dan committed suicide 13 years ago. He was just one of the 84 men who take their own lives every single week in the UK. Right now, there is no minister to represent the thousands of people affected every year by this silent killer, or those who feel like suicide is their only option or the bereaved families whose lives will never be the same again.

That’s why Matthew started this campaign to make sure a minister is responsible for suicide prevention and bereavement. Today is World Suicide Prevention Day and Matthew hopes that this could be the day people put pressure on the government by signing his petition.

Just one name on any list is too many -I lost a good friend when I was 22  his name was Christian and I have always asked myself what could I have done - suicide affects the whole community - it is a tragic waste of life - I still miss my friend his mother never really got over it especially as her husband had already died.

Weak & woolly - Beagles get rum deal


Mandate re-homing of suitable beagles and other species used for animal research.

The government responded – 18 June 2018
This Government encourages all scientific establishments that are licensed under the Animals (Scientific Procedures) Act (1986) to consider the re-homing of animals used in scientific research.
12,024 signatures 

So they respond with the fact they have given an advice note but without clear legislation, this means that the dogs basically are missing out. Its clear the petition wants more as it is not protecting the Beagles..

After the devastating news of a further severe stabbing of a brave Police Dog, Friday 6th July saw Finn’s Law pass through the 2nd reading at Westminster unanimously. Sir Oliver Heald’s Bill now moves on to the Committee stage.
The campaign to secure protection for our amazing animals has grown in strength and depth since the previous attempts at 2nd Reading. It is not uncommon for many Private Members Bills to fail at 2nd Reading stage. For Finn’s Law to go through 2nd Reading means that we are within touching distance of the statute books.

Nicola Skelley , Co-Director of Finn’s Law Ltd ,

said “We are extremely happy that #FinnsLaw has passed through the second reading, this has been a difficult hurdle and has caused many sleepless nights. We would like to say a huge thank you to Sir Oliver for believing in a dog called Finn and of course the many followers of Dave and Finn’s Law – #TeamFinn . Onwards to the next stage….. “
